29 CFR 1910.134(c)(2)(i): The employer did not determine if the voluntary use of a respirator did not in itself create a hazard. On or about October 5, 2023, and at times prior thereto, an employee voluntarily used a full-face, tight-fitting elastomeric respirator in the chassis shop without determining if a hazard was created, exposing the employee to cardiopulmonary physiological hazards.
