29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels or a dose of fifty percent: On or about January 18, 2024, the employer did not establish an audiometric testing program for all employees exposed to noise levels above an 8-hour time weighted average of 85 dBA while working in the processing areas of the plant. Noise dosimetry showed: a) An employee operating the jug line was exposed to noise at 77.7% of the permissible daily dose as measured over 573 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 86.8 dBA which exceeds the adjusted action limit of 83.7 dBA. b) An employee working on the jug line was exposed to noise at 65.3% of the permissible daily dose as measured over 591 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 83.5 dBA which equals the adjusted action limit of 83.5 dBA. c) An employee working on the liquifier and jug line was exposed to noise at 50.7% of the daily permissible daily dose as measured over 515 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 84.5 dBA which equals the adjusted action limit of 84.5 dBA. d) An additional five employees working on the half pint line and in HTST Processing had projected 8-hour TWAs ranging from 86.0 dBA to 87.8 dBA which exceeds the action limit of 85.0 dBA.
