29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer is failing to protect employees from elevated fall hazards. The condition was most recently observed on or about Nov. 28, 2023, when seven (7) employees were observed working on a roof at 122 Miranda Court in Wentzville, MO. The employer did not ensure that where portable ladders were used for access to an upper landing surface, and where the ladder's length allowed, the ladder's side rails were extended at least 3 feet (.9m) above the upper landing surface being accessed. The ladder the employees used to access the roof was approximately 2 feet and 10 inches above the roof landing surface H R Vasquez Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1556628, citation number 1, item number 2 and was affirmed as a final order on March 8, 2022, with respect to a workplace located at 1006 Regency Manor Drive in Ballwin, Missouri. H R Vasquez Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1607793, citation number 1, item number 2 and was affirmed as a final order on December 23, 2022, with respect to a workplace located at 1633 Kehrs Mill Road in Chesterfield, Missouri.
