29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a. 103-143 E 22nd St., Bayonne, NJ The employer did not ensure that an employee was protected from falls. An employee engaged in the delivery of materials, which included, but was not limited to counter tops and sinks, to the fifth level of a multi-unit residential building was not using any means of fall protection while guiding a JCB, Model 508-66TC, Telescopic Handler, up to the building to unload the materials and when unloading the countertops from a rack that was lifted up the opening and placed inside the building. Violation occurred on or about October 28, 2023
