29 CFR 1926.454(a)(3): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: (3) The proper use of the scaffold, and the proper handling of materials on the scaffold; a.) On May 17, 2023, the employer failed to ensure that an employee working to install a vapor barrier on an apartment complex roof was properly trained by a qualified person to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. As a result, the employee was exposed to a fall hazard at a height greater than 10', standing on the roof outside of the aerial lift, while still being connected to the aerial lift.
