29 CFR 1910.23(c)(11): The employer did not ensure that portable ladders used to gain access to an upper landing surface that have side rails that extend at least 3 feet (0.9 m) above the upper landing surface. (a) Second Processing - On or about July 14, 2023, the employer allowed a sanitation employee to use a portable fiberglass ladder to gain access to an elevated drip pan and the ladder did not have side rails that extended at least 3 feet above the drip pan, exposing the employee to a fall hazard of approximately 6 feet 10 inches to the concrete below.
