29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: a) 1 Orchard Beach Road, Bronx, NY - Orchard Beach Pavilion - South Loggia - Vestibule Ceiling - Demolition Area: Two employees were struck by a structural plaster ceiling which collapsed on them while they were performing manual demolition of the ceiling and were not instructed in the recognition and avoidance of unsafe conditions to control or eliminate exposure to struck-by hazards. b) 1 Orchard Beach Road, Bronx, NY - Orchard Beach Pavilion - South Loggia - Vestibule Ceiling - Demolition Area: On or about 7/13/23, employees performing manual demolition of the structural plaster ceiling which had extensive bird excrement, live birds, dead birds, feathers, etc. and were not instructed in the recognition and avoidance of the hazards associated with exposure to histoplasmosis and related illnesses. Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
