29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i). On or about July 7, 2023, and at times prior thereto, employees were exposed to fall hazards in excess of 4 feet high. a) Employees were at heights of approximately 15 feet, throwing debris from the second level of the building into a trailer that was at ground level without the use of fall protection. b) Employees were at heights of approximately 15 feet, throwing debris down a trash chute into a dumpster bin without the use of fall protection. c) Employees were standing on top of debris at a height of approximately 8 feet inside of a dumpster bin to even out the debris without the use of fall protection. d) Employees were at heights of approximately 4 feet on a work platform used to even out debris in the dumpster bin without the use of fall protection.
