29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person before the start of work and as needed throughout the shift. On or about June 18, 2023, employees installed utility pipes in an excavation that needed to be inspected throughout the shift for evidence of a situation that could have resulted in cave-ins. If inspected by a competent person, they would have discovered that the excavation did not have a means of egress or cave-in protection in class "c" soil in an excavation deeper than five (5) feet or that a means of egress was not present in the excavation that was deeper than four (4) feet and the spoils and the excavation was not two feet or more from the edge of the excavation.
