29 CFR 1910.1018(e)(2) as referenced in 29 CFR 1915.1018: Initial monitoring was not performed for each workplace, or work operation covered by 29 CFR 1910.1018 to accurately determine the airborne concentration of inorganic arsenic to which employees may be exposed: Location: 100 Military Ocean Terminal Street. Bayonne, New Jersey 07002. a) The employer did not perform initial monitoring to determine the airborne concentration of inorganic arsenic that employees performing abrasive sand blasting operations were exposed. On June 26, 2023 an employee performing abrasive sand blasting operations in a salt water storage tank was exposed to inorganic arsenic at concentrations of 35 micrograms per cubic meter of air, as an 8-Hour Time Weighted Average, exceeding the Permissible Exposure Limit (PEL) of 10 micrograms per cubic meter of air by 3.5 times. Zero exposure was assumed for the unsampled period of 230 minutes. Violation occurred on or around June 26, 2023.
