Text For Citation: 01 Item/Group: 002 Hazard:
29 CFR 1926.651(k)(1): An inspection of the excavation, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) Roadway in Front of 100 Olmstead Drive, Middletown, Pennsylvania - A competent person did not inspection the excavation, in that the foreman/supervisor, designated as the competent person, classified the soil in the excavation as a Type C soil but did not utilize protective systems for Type C soil (nor protective systems for Type B soil, the actual soil type), exposing employees to a cave-in hazard, on or about May 22, 2023. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
