29 CFR 1910.38(b): A written emergency action plan was not kept in the workplace, and available to employees for review. Where there were 10 or fewer employees the plan was not communicated orally to employees. On and before May 5, 2023, the employer had fewer than 10 employees and did not orally communicate the requirements of an Emergency Action Plan for the facility to employees, to include following as provided by 29 CFR 1910.38(c): (1) Procedures for reporting a fire or other emergency. (2) Procedures for emergency evacuations. (3) Procedures to be followed by employees who remain to operate operations before they evacuate. (4) Procedures to account for all employees after evacuation. (5) Procedures to be followed by employees performing rescue or medical duties.
