29 CFR 1910.119(n): The employer did not establish an emergency plan for the entire plant in accordance with the provisions of 29 CFR 1910.38: Sofo Foods of Ohio, LLC - Toledo, Ohio: On or about March 29, 2023, the employer did not ensure that the site's emergency plan included all elements in 29 CFR 1910.38. Specifically, the plan did not include the procedures for employees to initiate reporting an emergency, procedures to account for personnel after evacuation, procedures or designation of emergency medical responders, and job titles of emergency response coordinators or personnel. The failure to establish a complete emergency action plan can result in fire and ammonia inhalation hazards to employees in the event of an ammonia release.
