29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by a competent person prior to the start of work and as needed throughout the shift: On or about March 7, 2023, employees entering, working in and exiting an excavation approximately ten feet deep were exposed to cave-in hazards because the employer had not ensured a competent person conducted an inspection of the excavation that included the use of sloping, protective system, and adequate means of access and egress.
