29 CFR 1910.120(q)(3)(iii):Based on the hazardous substances and/or conditions present, the individual in charge of the ICS shall implement appropriate emergency operations, and assure that the personal protective equipment worn is appropriate for the hazards to be encountered. a.) On or about February 4 through February 8, 2023, in response to a train derailment incident that occurred on February 3, 2023 in East Palestine, Ohio where several train cars released several hazardous chemicals, such as, but not limited to n-Butyl Acrylate, the Employer did not ensure that employees who walked and worked in areas with soil that may have been contaminated with these chemicals wore appropriate chemical resistant footwear.
