29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: On or about February 17, 2023, at 3665 East 78th Street, Cleveland, OH 44105, the employer failed to ensure retraining for an employee that was in a PIV accident prior to permitting them to resume work on the forklift. The employee operated the forklift for approximately one week until until the day of their retraining.
