29 CFR 1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about March 2, 2023, during the replacement of storm sewers and storm water catch basins at a worksite located at 107 Barberry Dive, Berea, Ohio, the employer did not ensure an employee working inside a trench at a varying depth of approximately 5.5 feet to 6.5 feet, was protected from cave-in hazards by an adequately designed protective system. The soil would have been classified as; Type "C", previously disturbed, cohesive soil, with water freely seeping.
