29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment. At an establishment located at 210 Maple Street in Denmark, Wisconsin: a) On or about February 14, 2023, an employee repairing and assembling pallets with a pneumatic nail gun was exposed to noise at 76.3 percent dose of the permissible daily dose, or an average sound level of 95.3 dBA, as measured over 173 minutes of sampling of an 8-hour work shift. This dose is equivalent to an 8-hour TWA exposure of 88 dBA accounting for the period of 307 minutes unmonitored. b) On or about February 15, 2023, an employee repairing and assembling pallets with a pneumatic nail gun was exposed to noise at 267.8 percent dose of the permissible daily dose. This dose is equivalent to an 8-hour TWA exposure of 97.1 dBA, as measured over 480 minutes of sampling of an 8-hour work shift. c) On or about February 15, 2023, an employee operating a Go-Fast rip saw in the Ariens Building was exposed to noise at 102.9 percent dose of the permissible daily dose. This dose is equivalent to an 8-hour TWA exposure of 90.2 dBA, as measured over 480 minutes of sampling of an 8-hour work shift. d) On or about February 15, 2023, an employee operating a planer in the Main Room was exposed to noise at 97.3 percent dose of the permissible daily dose. This dose is equivalent to an 8-hour TWA exposure of 89.8 dBA, as measured over 480 minutes of sampling of an 8-hour work shift. e) On or about February 15, 2023, an employee operating a rip saw in the Main Room was exposed to noise at 70.5 percent dose of the permissible daily dose. This dose is equivalent to an 8-hour TWA exposure of 87.5 dBA, as measured over 480 minutes of sampling of an 8-hour work shift. f) On or about February 14, 2023, an employee repairing and assembling pallets with a pneumatic nail gun was exposed to noise at 100.1 percent dose of the permissible daily dose, or an average sound level of 97.3 dBA, as measured over 173 minutes of sampling of an 8-hour work shift. This dose is equivalent to an 8-hour TWA exposure of 90 dBA accounting for the period of 307 minutes unmonitored. g) On or about February 15, 2023, an employee repairing and assembling pallets with a pneumatic nail gun was exposed to noise at 212.2 percent dose of the permissible daily dose. This dose is equivalent to an 8-hour TWA exposure of 95.4 dBA, as measured over 480 minutes of sampling of an 8-hour work shift. h) On or about February 15, 2023, an employee operating an up-cut saw in the Ariens Building was exposed to noise at 124.1 percent dose of the permissible daily dose. This dose is equivalent to an 8-hour TWA exposure of 91.5 dBA, as measured over 480 minutes of sampling of an 8-hour work shift. i) On or about February 15, 2023, an employee assembling pallets with a pneumatic nail gun in the Aluminum Building was exposed to noise at 231.9 percent dose of the permissible daily dose. This dose is equivalent to an 8-hour TWA exposure of 96 dBA, as measured over 480 minutes of sampling of an 8-hour work shift. All provisions of 29 CFR 1910.95 (c) through (n) shall be contained in an effective hearing conservation program.
