29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. The employer continues to fail to instruct employees on the avoidance of unsafe conditions while they installed framing and sheathing to the roof top of a new build residential home. The most recent incident of such failure occurred at 1205 Lakeforest Lot 147, Hebron, Ohio 43025: On or about February 7, 2023, employees, without fall protection, were installing roof trusses and sheathing to the second story roof, thereby exposed to a fall hazard from approximately twenty feet. Fernando Alvarado was previously cited for a willful violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1543555, citation number 2, item number 2 and was affirmed as a final order on January 5, 2022, with respect to a workplace located at 8154 Comstock Terrace Nw, Pickerington, OH 43147 Fernando Alvarado was previously cited for a willful violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1499115, citation number 2, item number 1 and was affirmed as a final order on 03/01/2021, with respect to a workplace located at 3635 Mystic Way, Grove City, Ohio 43123. Fernando Alvarado was previously cited for a willful violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1427905, citation number 2, item number 1 and was affirmed as a final order on 11/21/2019, with respect to a workplace located at 12301 Greenwood Drive, Pickerington, Ohio 43123.
