29 CFR 1926.1204(d)(4): The employer did not provide personal protective equipment insofar as feasible engineering and work-practice controls do not adequately protect employees. On or about February 6, 2023, and at times prior thereto, employees were refitting an auxiliary boiler that was identified as a permit-required confined space. The employer allowed the employees to switch from mechanical ventilation to natural ventilation without demonstrating that natural ventilation eliminated or isolated atmospheric hazards, exposing employees to hazards associated with working in a permit-required confined space such as but not limited to asphyxiation and dizziness.
