Text For Citation: 01 Item/Group: 002 Hazard:
29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. a. Located at the vicinity of 840 West State Street, Columbus, Ohio: On or about February 02, 2023, the employer did not ensure that a competent person inspected the trench onsite to ensure that a protective system was in place in all areas of the trench where employees performed sanitary line installation work. A competent person did not instruct employees of unsafe conditions when work was performed outside of a shielding box in place exposing employees to cave-in hazards. b. Located at the vicinity of 840 West State Street, Columbus, Ohio: On or about February 06, 2023, the employer did not ensure that a competent person inspected the trench onsite to ensure that a protective system was in place in all areas of the trench where employees performed sanitary line installation work. A competent person did not instruct employees of unsafe conditions when work was performed outside of a shielding box in place exposing employees to cave-in hazards. Boss Excavating & Grading was previously cited for a serious violation of this Occupational Safety and Health standard 29 CRF 1926.651(k)(1), which was contained in OSHA inspection number 1446106, citation number 1, item number 2a and was affirmed as a final order on December 17, 2019 with respect to a workplace located at 9341 Jerome Road in Dublin, Ohio 43017.
