1-1 OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about January 12, 2023, on the site's north side yard area, excavator operator(s) parking heavy equipment did not ensure that other employees stay clear of the swing area/danger zone, exposing employees to being struck by or crushed when equipment is in motion. This exposed employees(s) to hazards which could lead to death or serious personal injury.
