29 CFR 1926.959(d)(2): The employer did not ensure that a designated employee other than the equipment operator observed the approach distance to exposed lines and equipment and provide timely warnings before the minimum approach distance required by paragraph (d)(1) of this section was reached: On or about 01/04/2023, on a worksite located at the intersection of SW 107th Avenue and 162nd Terrace in Miami, Florida, an employee was exposed to electrocution hazards when the employer failed to ensure that an observer was designated to observe and warn the employee working near energized and uninsulated 7,620-volt overhead power lines before the minimum approach distance was reached.
