29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: On or about December 22, 2022, the employer failed to ensure that the spoil pile of the trench that was being dug was at least 2' from the edge of the trench in order to prevent equipment and materials from falling in to the trench and possibly striking an employee or trapping them in the trench. The spoil pile found at the residential job site located at: 3427 Wyoga Lake Rd., Stow, OH 44224, was placed right at the edge of the trench and loosely piled at varying heights.
