29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: On or about 11/15/2022, the employer did ensure the inspections were conducted by a competent person who has the knowledge to identify hazards associated with working in an excavation. Employees were exposed to cave-in hazards when working in an unprotected excavation approximately ten (10) feet in depth, approximately fifteen (15) feet wide, approximately fifteen (15) feet in length, and comprised of material consistent with that of previously disturbed, backfill Type B soil.
