29 CFR 1910.28(b)(3)(i): The employer did not ensure each employee was protected from falling through any hole (including skylights) that was 4 feet (1.2 m) or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems: a) The employer is failing to prevent employee exposure to fall hazards. On or about November 1, 2022, at 3761 Eiler Street, Saint Louis, MO 63116, the employer did not ensure employees were protected from falling through skylights while cleaning out the gutters located on the Weld Shop roof. The two employees were exposed to an approximate 33-foot 8-inch fall hazard through the skylights. The exposed employees were not wearing any travel restraint system or personal fall arrest system and no guardrails or skylight cover was used. b) The employer is failing to prevent employee exposure to fall hazards. On or about November 14, 2022, at 3761 Eiler Street, Saint Louis, MO 63116, the employer did not ensure an employee was protected from falling through skylights while troubleshooting a HVAC Air Handler/furnace located on the 25-ton bay roof that was approximately 29 feet 9 inches above a lower level. The employee was exposed to fall hazards while working adjacent to a skylight; skylights are located on both sides of the HVAC Air Handler/furnace. The exposed employee was not wearing any travel restraint system or personal fall arrest system and no guardrails or skylight cover was used. c) The employer is failing to prevent employee exposure to fall hazards. On or about November 16, 2022, at 3761 Eiler Street, Saint Louis, MO 63116, the employer did not ensure an employee was protected from falling through skylights while covering the broken skylight with plywood after a fatal incident. The employee was exposed to fall hazards while working adjacent to skylights located on the sides of the HVAC Air Handler/furnace. The exposed employee was not wearing any travel restraint system or personal fall arrest system and no guardrails or skylight cover was used.
