29 CFR 1910.37(a)(3): Exit route(s) are not kept free and unobstructed: a) The employer fails to ensure effective measures to prevent fire and entrapment hazards as demonstrated on or about November 1, 2022, at or near 4027 North Dakota 37, Garrison, ND, in the back stockroom, where employees work and retrieve the merchandise. The emergency exit door was obstructed by store merchandise, roll-tainers, and U-boats, impeding direct means of egress for employees in the event of an emergency. To abate this violation, the employer must ensure that all emergency exit routes are kept unobstructed and free from product to ensure a safe walkway for employees to exit the emergency exit door in case of an emergency.
