The employer routinely fails to assure effective protection against unsafe stacking of material as required by the standard, as demonstrated on or about October 31, 2022, when employees were not protected from struck-by hazards due to the unsafe stacking of material at 907 Boston Post Road, Unit B, Old Saybrook, CT 06475. Dollar Tree Stores, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.176(b), which was contained in OSHA Inspection Number 1431460, citation number 1, item number 2 and was affirmed as a final order on April 05, 2021, with respect to a workplace located at 1041 Commonwealth Avenue, Boston, MA 02134. To abate this violation, the employer must ensure that adequate stacking of material is maintained. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance; including an explanation of how these steps protect employees from struck-by hazards due to the unsafe stacking of material that may result in injuries.
