29 CFR 1910.178(q)(1):Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: The employer is failing to protect employees from struck by hazards associated with the use of power-operated industrial trucks that are not in safe operating condition. This was most recently documented on August 10, 2022, and November 3, 2022 when the employer allowed an employee to use a power-operated industrial truck while the back-up light was not operational.
