29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about August 3, 2022, the employer did not ensure that employees were protected from hazards associated with operation of the Stihl TS-420 cut-off saw, in that employees were not instructed in the recognition and avoidance of unsafe operating conditions and to operate the saw per the manufacturer's instructions. The employer did not provide training to employees addressing the manufacturer's instruction that pipes be supported and secured when being cut. An employee using the cut-off saw to cut through an eight inch ductile iron pipe which had not been supported or stabilized was fatally injured as a result of the saw binding and subsequently kicking back.
