29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) 2155 Cobb Pkwy SE, Smyrna, GA: On or about 4/19/2022, the employer exposed employees to struck-by hazards, in that a cave-in protection system was not provided for employees installing 40-inch storm line pipe in an excavation that measured 85-feet long by 13-feet wide by 7.5-feet deep. Gorman Construction, Inc. was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1447338, citation number 1, item number 2 and was affirmed as a final order on 03/23/2020, with respect to a workplace located at 5081 Cherokee Street, Acworth, GA 30101. Gorman Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1363363, citation number 1, item number 2 and was affirmed as a final order on 03/19/2019, with respect to a workplace located at 2416-2498 Barrett Creek Parkway, Marietta, GA 30066.
