29 CFR 1910.119(h)(2)(iii):The employer did not explain the applicable provisions of the emergency action plan to contract employers who work on or adjacent to a covered process. (a) On or about April 5, 2022 and at times prior thereto in the MR3 Unit of the Covestro chemical manufacturing complex in Baytown, Texas, the employer did not inform contract employers that self-contained breathing apparatus must be used in the presence of any toxic atmosphere and did not inform contract employers that workers must evacuate the unit when phosgene is detected.
