29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access: a) Sea Glass Apartments at 32815 Azure Avenue Rehoboth Beach, DE 19971: On or about March 16, 2022, the employer failed to ensure employees used ladders that extended at least 3 feet above the upper landing to access the upper levels of a multi story building, exposing employees to fall hazards approximately 41 feet above grade. Delmarva Roofing & Coating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1530769, citation number 1, item number 4 and was affirmed as a final order on December 6, 2021 with respect to a workplace located at The Hyatt House at 17254 Five Points Square Lewes, DE 19958.
