29 CFR 1910.178(p)(1): Powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a. 300 Port Street Newark, NJ The employer did not ensure that powered industrial trucks found in need of repair were taken out of service. Employees operated equipment that included, but was not limited to a Toyota, model 8FGCU2, Propane Forklift that had defective/damaged tires, causing tires to lose traction, exposing employees to tip-over hazards.
