29 CFR 1910.119(e)(3)(iv): The process hazard analysis did not address the consequences of failure of engineering and administrative controls: On or about January 05, 2022, KOCH and contract employees engaged in supporting, contracting, operating, inspecting, testing, and maintaining activities at the covered process equipment throughout the plant were exposed to catastrophic release of ammonia which results in asphyxiation, chemical burns, explosion and flash fire leading to death and injury to persons in and near the facility in that the employer failed to verify that the engineering and administrative controls complied with recognized and generally accepted good engineering practices such as IIAR Bulletin #111 06/02; ANSI/ISA; S91.01-1995; ANSI/ASHRE-15 2007; ANSI/IIAR 2-2008. The consequences of failure of engineering and administrative controls applicable to the hazards and their interrelationships such as appropriate application of detection methodologies to provide early warning of releases were not implemented to assure that the system operating modes are working at all times, the systems will reliably function when the need arises. The employer did not ensure that the alarm systems are always working. a) The alarms did not sound, the evacuation sirens did not audibly alarm. b) The employee alarm systems were not maintained in operating condition.
