Text For Citation: 01 Item/Group: 002 Hazard:
29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. On or before January 10, 2022, the employer did not ensure that each powered industrial truck operator was competent to operate the powered industrial truck safely. The employer did not evaluate an employee's competency when they operated the powered industrial vehicle such as, but not limited to the JLG, Skytrack, Rough Terrain Forklift at the worksite. As a result employees were exposed to struck-by hazards.
