29 CFR 1910.178(q)(1):Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: On or about December 8, 2021 at D&D Ingredient Distributors Inc. within the Flat Blending Building located at 5191 Kill Rd. Delphos OH 45833, the employer did not ensure that Caterpillar unit 29 forklift was removed from service when the mast chain pulley had become stuck, and the chain came off its track. The employer did not ensure the forklift then was repaired by an employee who was authorized to work on the forklift, resulting in the employee becoming injured when the mast chain pulley pinched the employee's left hand.
