29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace: At a worksite located at 2915 Nicholson Ave, Kansas City, MO 64120: Employees were exposed to health hazards in that they may be harmed by the use of a respirator. The employer as part of their respiratory protection program failed to medically evaluate employees prior to providing them with a tight-fitting respirator. a) This was demonstrated on or about November 23, 2021, and at times prior to, when employees were exposed to respiratory hazards when employees were directed to use a tight-fitting elastomeric respirator while exposed to potentially toxic or hazardous substances. b) This was demonstrated on or about March 21, 2022, and at times prior to, when employees were exposed to respiratory hazards when employees were directed to use a tight-fitting elastomeric respirator while exposed to potentially toxic or hazardous substances.
