29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. The employer does not protect each employee from fall hazards while performing roofing activities on residential homes and or structures with unprotected sides and edges at heights of approximately 19.2 feet above the ground by the use of guard rail systems, safety net systems, and or personal fall arrest systems. This most recently occurred on October 15, 2021, during the installation of roofing material at a job site located at 1031 Minuteman Ave NW, Massillon, Ohio 44646; the employer did not ensure employees working on a roof of a single family home were protected from a fall of approximately 19.2 feet by utilizing a fall protection system.
