OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from caught in and struck by hazards relating to maintenance and installation racking systems. a. 156 West Harrisburg Avenue Elizabethtown, Pennsylvania - On or about October 19, 2021, in the Blending area, the left hand upright for the pallet rack on the Polly Racking, where packaging materials were stored, was not anchored, exposing employees to a caught in and struck by hazard. b. 156 West Harrisburg Avenue Elizabethtown, Pennsylvania - On or about October 19, 2021, in the blending area, the left hand upright and the upright near marking PO3 on the Polly racking damaged. The rack stability and strength were not evaluated, exposing employees to a caught in and struck by hazard. c. 156 West Harrisburg Avenue Elizabethtown, Pennsylvania - On or about October 19, 2021, in the forklift battery charging area, the pallet racking upright was damaged. The rack stability and strength were not evaluated, exposing employees to a caught in and struck by hazard. d. 156 West Harrisburg Avenue Elizabethtown, Pennsylvania - On or about October 19, 2021, in the freezers 1, 2, 3, and 4, the pallet racking systems had damage to the base of the structural uprights. The rack stability and strength were not evaluated, exposing employees to a caught in and struck by hazard. e. 156 West Harrisburg Avenue Elizabethtown, Pennsylvania - On or about October 19, 2021, all of the racking systems both pallet and drive in, throughout the facility were not evaluated and marked for capacity, exposing employees to a caught in and struck by hazard. f. 156 West Harrisburg Avenue Elizabethtown, Pennsylvania - On or about October 19, 2021, throughout the facility the pallet rack systems did not have beam locking devices to prevent the dislodgement of the load bearing cross members, exposing employees to a caught in and struck by hazard. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
