29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift: a) Castillo Excavating, Inc., 152 Baylor Drive, Longmont, CO 80501: On or about September 7, 2021, while in the process of replacing a sewer-line in an unprotected trench that measured 7- 8 feet in depth, a section of the trench collapsed trapping an employee. The employer failed to ensure that the excavated area was inspected by a competent person prior to the start of work activities, and as needed throughout the shift for evidence of conditions issues (e.g.: soil sloughing; Fissures or cracks, etc.) that would affect the integrity of the trench.
