Text For Citation: 01 Item/Group: 002 Hazard:
29 CFR 1910.502(c)(4)(ii):In order for an employer to be exempt from providing controls in a well-defined area under paragraph (a)(4) of this section based on employees' fully vaccinated status, the COVID-19 plan must include policies and procedures to determine employees' vaccination status. On or about August 10, 2021, the employer, Generations at Neighbors, LLC, did not include policies and procedures in the COVID-19 plan that determine employees' vaccination status. With less than 40% of the staff vaccinated, the employer was not exempt from providing controls, including but not limited to "physical distancing" and "physical barriers" at areas such as but not limited to the Main Nurses' Station and the Patients Under Investigation (PUI) Nurses' Station in the 500 Wing of the Facility. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
