29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a) Refrigerated Warehouse, inside the freezer - On or about October 5, 2021, and on prior dates, the employer failed to prevent the use of work platforms, not approved for use by forklift manufacturers, such as Nissan, for fork-lifting these platforms while occupied by employees, to heights, exposing employees to a fall hazard. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
