29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Dunaway Excavating, Inc. at 4387 Lacewood Lane, Johnstown, CO 80534: On April 16, 2021, the employer failed to ensure that a stairway, ladder, ramp or other safe means of egress was located in an excavation. Two employees excavated a trench approximately 16 feet deep that had accumulated water at a depth of at least two feet to install a sewer tie-in. Two ladders were found in the trench, neither of which extended three feet beyond the top of the excavation and one of the ladders was damaged. The adjacent trench which was used to lay the sewer pipes, was also used by employees to access and egress the excavation and was greater than five feet deep without trench protection. This condition exposed employees to cave-in and struck-by hazards.
