29 CFR 1960.8(a): The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm in that the Moisture Separator/Blow-in Panel Set three-position control switch was defective and allowed for the switch to be inadvertently turned without depressing it, subsequently resulting in the death of an employee from a caught-between hazard inside the closing area of the gas turbine inlet blow-in panel door. On or about 03-15-2021 and times prior thereto, onboard the USS McFaul, DDG-74 located at General Dynamics - NASSCO Norfolk 200 Ligon Street. Norfolk, VA 23523: the employer did not provide mechanically safe components located on shipboard system equipment that exposed employee(s) to pinch point and caught between hazards. Specifically, the three positions control switch located in the engine room that operated the Moisture Separator/Blow-in Panel Set was defective and did not operate as designed by the manufacturers technical manual S9234-GB-MMA-010/46219, 0910-LP-231-1900 . The control switch had three positions: AUTO, CLOSED, and OPEN and the switch must be depressed prior to changing its position to open or close the remote filter door set. This switch was defective and the required safety feature "Push to Turn" did not function, which allowed the switch to be turned freely, actuating the blow-in doors without pushing it inward to turn while the employee was inside the closure area of the filer panel blow-in door Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employee(s) and their representatives were informed of this abatement.
