29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety: (a) Reynold's Construction job #42004 in Parker, CO: On or about February 2, 2021, and at times prior, the employer exposed employees to struck-by hazards from falling or sloughing soil while performing 30" sewer line installation operations in an excavation at 17.9 feet in depth in Type C soil. The employer did not ensure daily inspections of an excavation and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition, in that the competent did not identify the lack of an appropriate protective system or did not take prompt corrective action to eliminate the cave-in hazard.
