29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: (a) JBC Ent., Inc., at 3319 N Clayton Street, Denver, CO: On 11/25/2020 sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures. An employee used an excavator to tear down the concrete walls of an approximately twelve foot deep basement. Following this, the north wall and significant sections of the east and west walls were removed and unsupported vertical earth was exposed. The supporting structure for a metal and concrete stairway was undermined during the demolition of the concrete wall in the northeast corner. The stairway collapsed into the excavation. An employee working in proximity to the stairway also fell into the excavation. The employee died as a result of injuries sustained in the fall. This condition exposed the employee to an excavation related collapse hazard.
