29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. The employer is failing to ensure that powered industrial trucks were used within their rated capacities. On November 10, 2020 an employee was operating a Genie GTH-636 telehandler at or near Blanchette Memorial Bridge, Maryland Heights, Missouri. The forklift in the configuration in which operated equipped with a Star Industries Lift & Tow Model 1390B fork attachment was operated above the rated capacity becoming unstable and pitching forward until the telehandler was lifted from the bridge platform falling approximately 80 feet to the ground below fatally injuring the operator.
