29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident: a) Care One at Livingston Assisted Living, 76 Passaic Avenue, Livingston, NJ 07039 The employer failed to report the death of a Certified Home Health Aide who died of a confirmed case of COVID-19 on April 8, 2020. The employer became aware of the death on April 9, 2020, and the fatality was not reported to OSHA until July 23, 2020. Violation occurred on or about April 9, 2020.
