29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared: a) On or about September 9, 2020 at the Valencia Lakes Subdivision, Wimauma, FL employees performing landscaping activities were exposed to noise levels at 167-223.2% of the allowable 8-hour Time Weighted Average (90 dBA), with an equivalent dBA level of 93.7-95.8 dBA. The employer failed to require a baseline audiogram within six months of the employee's first exposure above the action level.
